ARTICLE 1 – DEFINITIONS In these terms and conditions:

Cooling-off Period: The period in which the consumer may exercise their right to cancel.

Consumer: A natural person not acting in a professional or commercial capacity who enters into a distance contract with the trader.

Long-term Transaction: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligations extend over time.

Durable Medium: Any means that allows the consumer or trader to store information addressed personally to them for future reference and unaltered reproduction.

Right to Cancel: The right of the consumer to withdraw from the distance contract within the cooling-off period.

Trader: The natural or legal person offering products and/or services remotely to consumers.

Distance Contract: An agreement made through an organised system for remote sales or services without the simultaneous physical presence of the trader and consumer.

Remote Communication Technology: Tools used to conclude a contract without the physical presence of both parties.

Terms and Conditions: The present terms and conditions of the trader.

ARTICLE 3 – APPLICABILITY These terms apply to all offers made by the trader and all distance contracts and orders made by consumers.
Prior to concluding the distance contract, the consumer will be provided access to these terms and conditions. If not feasible, the trader will specify where the terms can be reviewed and that they will be sent free of charge upon request.
If the contract is concluded electronically, the trader shall provide the consumer with the terms in a way that allows permanent storage for future reference. If not possible, the trader will indicate where they can be accessed electronically and send them upon request.
If specific product or service terms also apply, these provisions are likewise applicable. In case of conflicting clauses, the consumer may rely on the one most favourable to them.
If any term proves invalid, the remainder of the agreement remains valid. The void clause shall be replaced by one that closely aligns with the original intent.
Ambiguities or gaps shall be interpreted in the spirit of these conditions and both parties' interests.
ARTICLE 4 – THE OFFER If the offer has a limited duration or is conditional, this will be clearly stated.
Offers are non-binding. The trader reserves the right to modify or cancel the offer.
The offer will include a complete and accurate description of the products/services offered, sufficient for proper consumer understanding. Images used are representative. Obvious errors do not bind the trader.
All visuals and specifications are indicative only.
Each offer contains clear information on:

The price, excluding any customs duties and VAT.

Shipping costs.
-
How the contract is concluded and required actions.
-
Whether the right to cancel applies.
-
Accepted payment, delivery, and performance methods.
-
Timeframe to accept the offer.
-
Whether the contract will be stored and accessible.
ARTICLE 5 – THE AGREEMENT The contract is concluded when the consumer accepts the offer and complies with the stipulated terms.
If the offer is accepted electronically, the trader must confirm receipt immediately. Until confirmed, the consumer may cancel.
The trader ensures secure data transmission. For online payments, appropriate security measures will be used.
The trader may assess creditworthiness. If concerns arise, they may decline the order or impose conditions.
The consumer will receive the following:

The trader’s business address for complaints.

Instructions on the right to cancel.

Details on after-sales service and warranties.
-
Contract conditions if applicable to ongoing contracts.
All agreements are subject to product availability.
ARTICLE 6 – RIGHT TO CANCEL Consumers may withdraw from the contract within 30 days of product receipt without providing a reason.
Products must be handled with care and only tested as necessary.
The intention to cancel must be communicated within 14 days by email or letter. The product must be returned within 14 days of this notice.
If no return occurs within the period, the purchase becomes binding.
ARTICLE 7 – RETURN COSTS Return shipping is the consumer’s responsibility.
Refunds will be processed within 14 days of return or evidence of dispatch.
ARTICLE 8 – EXCLUSIONS TO RIGHT TO CANCEL The right to cancel may be excluded for:

Custom-made items.

Personalised goods.

Items not suitable for return due to hygiene reasons.
Exclusions must be stated clearly.
ARTICLE 9 – PRICING Prices remain valid during the offer period, unless legal adjustments require changes.
Consumers are responsible for customs fees and VAT.
ARTICLE 10 – COMPLIANCE AND WARRANTY The trader warrants product conformity.
Faults or incorrect deliveries must be reported within 14 days. Returns must be in original, unused condition.
No warranty applies for misuse or unauthorised alterations.
ARTICLE 11 – DELIVERY & PERFORMANCE Delivery is to the consumer’s address.
Orders will be fulfilled within 30 days. Delays or issues will be communicated.
Replacements are only shipped with consumer consent.
Risk of loss or damage transfers upon delivery.
ARTICLE 12 – DURATION CONTRACTS & TERMINATION Open-ended contracts can be cancelled with one month’s notice.
Fixed-term contracts may not be automatically renewed unless agreed.
ARTICLE 13 – PAYMENT Unless agreed otherwise, payments are due within 7 working days after the cooling-off period or upon confirmation of a service contract.
Consumers must promptly correct any payment data errors.
Failure to pay may incur reasonable recovery costs after prior warning.
ARTICLE 14 – COMPLAINTS Complaints must be reported within 7 days after discovery with clear description.
Responses will be given within 14 days. If extended time is needed, the consumer will be informed.
Unresolved complaints constitute a dispute.
Filing a complaint does not exempt the trader from their obligations unless otherwise stated.
If the complaint is valid, the trader may replace or repair the item at no cost.
ARTICLE 15 – DISPUTES Contracts are subject to the law of Hong Kong SAR, even if the consumer resides elsewhere.
